Trade Secret Services
Which do I choose: patent or trade secret?

Many considerations come into play when determining whether to protect your innovation with a patent or to guard it closely as a trade secret.  A patent expires after a given amount of time and requires public disclosure of the invention.  Whereas a trade secret may continue indefinitely as long as it remains a secret.

It is important to perform regular intellectual property audits in a company.  Not only is it crucial to identify any potential intellectual property, but it is even more important to determine how best to protect it.  Where applicable, it may be in the company’s best interest to protect an innovation as a trade secret, rather than to publicly disclose it by obtaining a patent.

Trade secret protection depends entirely upon whether the trade secret owner has taken reasonable steps to protect it.  Creating and implementing a comprehensive trade secret protection plan is crucial to establishing and guarding a trade secret.
