Do I need to register my trademark?
Federal registration of a mark is not required, although it is highly recommended because of the advantages that it affords. A federally registered mark provides the registrant with the exclusive right to use the mark in connection with the goods/services listed in the registration. It also serves as notice to the public of the registrant’s ownership of the mark
When selecting a name for your business or products, you should determine whether that name is already being used by someone else in connection with goods/services similar to yours. A trademark search will help identify marks that may pose an obstacle to your use of it.
It is important to carefully select your mark, as marks that are merely descriptive, will not be afforded trademark protection. Registering your mark also takes a good amount of forethought and planning because when registering your mark, you must identify the class/classes of goods/services that the mark will be used in connection with.
Oftentimes, trademark ownership may be transferred from one person or entity to another. Recordation of documents involving the transfer of trademark ownership is not required, but is encouraged.
